The countdown is now on to the final, extended ESOS deadline of 29th January. We’re literally watching the countdown clock tick with just over 12 hours to go until the midnight cutoff.
The original deadline was 5th December 2015, but due to the numbers of companies that hadn’t submitted their requirements, the Environment Agency (EA) showed some leniency and provided a new deadline of 29th January 2016, by which time companies had to either complete compliance, or notify their scheme regulator of a future date by which they expect to be compliant.
Even with the extended deadline it seems that many companies have yet to comply or notify the EA of late compliance. Industry figures have recently stated that as many as 3,000 companies were still outstanding in their obligations. The Environment Agency are said to have sent out another round of letters to those companies who have not yet complied or notified a late compliance; outlining the risks of enforcement action if they do not comply.
Having already extended the deadline, action is likely to be taken.
However, the EA have previously stated that they will be more understanding if a company has submitted an intention to comply notification. Those companies who have not yet achieved compliance or submitted an intent to comply notice are advised to complete the form as soon as possible using this link:
Then to avoid penalties which could easily run into tens of thousands, take swift action to arrange ESOS audits and reports for submission to the Environment Agency.
