As the ESOS submission deadline looms just 50 days away, a new amendment has allowed for a compliance extension on the basis that qualifying businesses submit an official notification of lateness to the Environment Agency.
“We do not expect to normally take enforcement action on organisations that submit an ESOS notification of compliance by 29 January 2016 providing they have told us by the 5 December that they are going to be late.”
But before you start to rejoice, the report will still need to be submitted legally by the 29th January 2016 at the latest. Any delay notifications will need to explain why the business has been unable to comply and when it expects to submit its notification of compliance.
It will help if the business has shown willing towards completing their audit such as having booked a lead assessor, conducting site visits or starting to collate data.
It also makes sense to start organising your audit early, as with so many businesses left to comply, we expect there to be a last minute rush to book in a lead assessor in January. Of course, other businesses offering ESOS services will capitalise on demand in the New Year and raise their prices.
